
Kit Loop — Terms of Use

App: Kit Loop
1. Agreement
By downloading, accessing, or using KitLoop, you agree to these Terms of Use (the “Terms”) and our Privacy Policy at https://www.tobeproduction.com/kitloop-pp. If you do not agree, do not use the App.
These Terms are between you and To Be Production. Apple is not a party to these Terms, except as a third-party beneficiary of Apple-required clauses below where applicable.
2. The Service
KitLoop is a mobile application that helps you:

Create and manage kits and items
-
Pack and return gear for trips
-
Use QR labels/scanning features
-
Export labels, share kits, create backups, and generate reports/PDFs
Features may differ between Free and Pro plans and may change over time.
3. Eligibility
You must be able to form a binding contract under applicable law and comply with App Store rules. If you use KitLoop on behalf of an organization, you represent that you have authority to bind that organization.
4. License
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use KitLoop on Apple devices you own or control, as permitted by the App Store Terms of Use / Apple Media Services Terms.
You may not:

Copy, modify, reverse engineer, or create derivative works of the App except where mandatory law allows

Rent, lease, sell, sublicense, or redistribute the App

Bypass Free/Pro limits, payment systems, or security features
-
Use the App for unlawful, harmful, infringing, or abusive purposes

Interfere with the App’s normal operation

5. Your Content and Responsibility
You are responsible for:

The accuracy of kits, item names, notes, photos, trip marks, and reports you create

Backing up important data
-
Deciding whom you share kits, backups, reports, or PDFs with
-
Complying with laws when photographing property or sharing information
KitLoop is a productivity/checklist tool. It does not replace professional inventory systems, insurance documentation, chain-of-custody requirements, or legal evidence procedures unless you independently choose to use exported files for your own purposes.
6. Free and Pro Features
Free use may be limited (for example number of kits, items per kit, and open trips). KitLoop Pro may unlock higher or unlimited limits as described in the App.
Pro access may be obtained via:

Auto-renewable subscription (e.g., monthly or yearly), and/or
-
One-time purchase (lifetime), if offered
Exact product availability, pricing, and local taxes are shown by Apple at purchase time in the App Store / StoreKit purchase sheet.
7. Subscriptions, Renewals, and Lifetime Purchases
If you purchase an auto-renewable subscription:

Payment is charged to your Apple ID

The subscription renews automatically unless canceled at least 24 hours before the end of the current period

Your account may be charged for renewal within 24 hours prior to the end of the current period

You can manage or cancel in your Apple ID account settings (Subscriptions)

Deleting the App does not automatically cancel a subscription
If you purchase a one-time/lifetime product:

It is a non-consumable purchase processed by Apple

It does not automatically cancel an active subscription; you must manage/cancel the subscription separately in Apple ID settings if you no longer want renewals
Promo codes, if offered, are subject to their stated conditions and may be modified or discontinued.
8. Restores and Apple Billing
Use Restore Purchases in the App when switching devices or reinstalling. Billing, refunds, chargebacks, payment failures, family sharing eligibility (if any), and purchase history are governed by Apple’s terms and support processes.
9. Sharing, Import/Export, and Reports
Shared kit files, backups, return reports, and PDFs are snapshots you create. Recipients do not automatically receive later edits unless you share again. You are responsible for reviewing shared content before sending it.
10. Intellectual Property
KitLoop, its name, logos, design, and software are owned by Developer or its licensors. These Terms do not transfer ownership of the App to you. You retain rights to your own content.
11. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TO BE PRODUCTION AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE APP OR SHARED FILES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR KITLOOP PRO ACCESS DURING THE 12 MONTHS BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID TO APPLE AS STORE FEES WHERE NOT RECEIVED BY US AS A DIRECT CONSUMER CHARGE UNDER THESE TERMS) OR (B) USD $50, EXCEPT WHERE PROHIBITED.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, THE LIMITATIONS APPLY TO THE FULLEST EXTENT ALLOWED.
13. Indemnification
You agree to defend and indemnify the Developer against claims arising from your improper use of the Application, your use of your content, or your distribution of files, except where such claims are caused by the Developer's willful misconduct.
14. Termination
You may stop using the App at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the App. Provisions that should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.
15. Changes
We may update the App and these Terms. Continued use after changes become effective constitutes acceptance of the updated Terms, except where additional consent is required by law.
16. Governing Law
These Terms are governed by the laws applicable to Developer’s principal place of business, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise.
17. Apple-Required Terms (App Store)
You acknowledge that:

These Terms are between you and (Developer) Ivan Ryzhak only, not Apple

TDeveloper (not Apple) is responsible for the App and its content
-
Apple has no obligation to provide maintenance or support for the App
-
In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation

Developer (not Apple) is responsible for addressing product claims, including product liability, legal/regulatory compliance, and consumer protection claims

In the event of a third-party intellectual property claim related to the App, Developer (not Apple) is responsible for investigation, defense, settlement, and discharge as required
-
You represent you are not located in a U.S.-embargoed country and are not on a U.S. government prohibited/restricted party list

You must comply with applicable third-party terms when using the App
-
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you
Usage must also comply with the Apple Media Services Terms / App Store Terms of Use.
